Ryan leads unbeaten Falcons over Eagles 30-17

PHILADELPHIA (AP) ? Asante Samuel stared directly at his former team's sideline and started trash-talking right after the coin toss. By the fourth quarter, Samuel was dancing on the field between plays.

Matt Ryan made it easy for his loquacious teammate to gloat.

Ryan threw touchdown passes on Atlanta's first three possessions against the Eagles and new defensive coordinator Todd Bowles, and the Falcons remained the NFL's only unbeaten team with a convincing 30-17 win over Philadelphia on Sunday.

"We're 7-0 over here baby," Samuel said. "If I was over there now, they have to go to work."

The Falcons are 7-0 for the first time in the franchise's 47-year history while the Eagles (3-4) lost after a bye for the first time in 14 games under coach Andy Reid since 1999.

"That was an embarrassing performance," Reid said. "I'm stating the obvious. We need to get better. I need to do a better job. This is fixable. We have the talent."

Ryan finished 22 of 29 for 262 yards and three TDs for his first win against his hometown team in three tries.

Michael Vick didn't turn the ball over for once, but he played so-so and failed to beat his former team in his second start against the Falcons since returning to the NFL in 2009.

"Whatever decision coach makes, I support it," Vick said when asked about possibly being benched for rookie Nick Foles. "I know I'm giving it everything I have when I'm out there."

Reid said he's going to evaluate whether he makes a quarterback change. The defense was the problem against Atlanta, however.

The Falcons scored on their first six possessions before punting for the first time with 5:35 left.

"When you do that, it's going to be a good day," Ryan said.

This was a validation win for Atlanta. The Falcons entered with no victories over a team with a winning record and their opponents were a combined 13-24 going into this weekend. Perhaps that's why they were a surprising 3-point underdog despite Philadelphia's recent struggles.

"We like to have a lot of fun," Falcons coach Mike Smith said. "We have a very mature group. We have a bunch of guys who are mentors. We're good at focusing on the task at hand. We're on point when we kick off and guys have done a good job focusing all season."

Reid's Eagles have lost three in a row since starting 3-1. Reid fired Juan Castillo and replaced him with Bowles two days after Philadelphia blew its second straight fourth-quarter lead in an overtime loss to Detroit.

Clearly, it didn't work.

Castillo's defense allowed 18.5 points per game, excluding two TD returns against the offense. Bowles' D allowed 21 points in the first 24 minutes and couldn't make a stop until the fourth quarter.

"I did what I did and what I thought was right at the time," Reid said about the switch. "We need to get better there."

A sellout crowd anticipating a pending storm expected to hit the East Coast soon started filtering out in the third quarter. Those who stuck around booed the Eagles off the field, though one guy chanted "E-A-G-L-E-S" in the final minute.

The anti-Reid fans may be seeing him in his final months with the team. Owner Jeffrey Lurie already stated before the season that another 8-8 finish would be "unacceptable."

The Falcons methodically drove 80 yards on 16 plays on the opening possession, converting five third downs. A holding call on defensive end Jason Babin kept the drive going after Ryan threw an incomplete pass on third-and-10. Ryan then threw a 15-yard TD pass to Drew Davis for a 7-0 lead.

Ryan tossed a 3-yard TD pass to Jason Snelling to make it 14-0. Penalties on Dominique Rodgers-Cromartie and Mychal Kendricks on separate third downs kept Atlanta's drive going.

After going three-and-out on the first series, the Eagles put it together on the next drive by mixing in seven runs among their 13 plays. LeSean McCoy scored from the 2 to cut it to 14-7.

But the Falcons answered quickly. Ryan connected with Julio Jones over Nnamdi Asomugha for the 63-yard score to put Atlanta up 21-7.

Atlanta converted their first nine third-down tries, including three by penalty. The Eagles finally held in the final minute of the second quarter and Matt Bryant's 43-yard field goal gave the Falcons a 24-7 halftime lead. Bryant kicked field goals of 29 and 30 on the next two drives.

The Eagles made it 30-17 on Vick's 7-yard TD pass to McCoy in the fourth quarter.

Samuel had 25 interceptions and went to three Pro Bowls in four seasons in Philadelphia before the acquisitions of Asomugha and Rodgers-Cromartie forced him out. He was traded to the Falcons for a seventh-round pick in April and enjoyed his return to Lincoln Financial Field.

"I love the fans," he said. "They can boo me. They can cheer for me. Doesn't do anything but add fuel to the fire."

NOTES: The Falcons won in Philadelphia for the first time since Oct. 30, 1988. They were 0-6 with two playoff losses. ... Neither team had a turnover. ... The Eagles got their first sack in four games since Week 3. ... Eagles rookie Dennis Kelly took his first snap in the NFL, starting for the injured Danny Watkins (ankle) at RG. ... Kendricks was benched for the first series for disciplinary reasons. Casey Matthews took his place at strongside LB. ... Falcons coach Mike Smith moved past Dan Reeves into first place on the club's all-time list with 50 wins.

Elder Law, Drug and Device Laws and Insurance Laws: Contents of ...

Individual Responsibility: Subtitle F, Part I, is ironically entitled ?Individual Responsibility?. I say ?ironically titled? because Mitt Romney, who believes 47% of the US population takes no individual responsibility, wants to repeal this provision. This is the provision that was upheld by the United States Supreme Court. Under this provision, individuals are fined $750 on their personal tax return if they do not purchase minimal essential health care coverage during a calendar year. This is phased in at a rate of $95 for 2014 and $315 for 2015. If an individual goes one month without minimal coverage the fee is 1/12 of this amount. ?Minimal Essential Coverage? includes Medicare, Medicaid, CHIP, Tricare, Veteran?s plans, and plans for Peace Corp volunteers. It also includes employer-sponsored plans, individual plans and grandfathered plans. Although the penalty is collected on your income tax form, the law expressly prohibits the Depart of Treasury from filing criminal charges against you if you don?t pay the penalty and also prohibits the IRS from filing liens and levies against your property to collect the fee. The US Supreme Court debated as to whether it was constitutional for the government to require you to purchase health insurance, and this provision was upheld under Congress?s taxing power. Beginning in 2014, your insurer will send you a formal notice of your coverage for tax purposes. Employers shall also be required to file a return regarding coverage of their employees and also to provide notice to their employees. Assisted Suicide: The law prohibits discrimination against individuals or health care entities on the basis that they refuse to execute assisted suicide, mercy killings or euthanasia. Expansion of Medicaid. The law required the states to expand Medicaid by offering it to anyone with an income of %133 of the federal poverty line but the United States Supreme Court struck down this requirement. It is now optional for the states. Children?s Health Insurance Plan (CHIPs): The law enhances funding for this federal program to assist the states in providing health insurance for Children.

Hawaii tsunami: Smaller waves than predicted after Canada quake

Hawaii tsunami: Initial tsunami waves are small. But Hawaii residents got a good test of tsunami preparedness in the wake of Saturday's magnitude 7.7 earthquake off Canada.

Gerard Fryer, a geologist tracking the tsunami for the Pacific Tsunami Warning Center, said the largest wave in the first 45 minutes of the tsunami was measured in Maui at more than 5 feet, about 2 feet higher than normal sea levels.

State and local officials warned residents and tourists not to go back to inundation zones until an all-clear is given, though no major damage was reported.

    RELATED: Five biggest tsunamis

At first, officials said Hawaii wasn't in any danger of a tsunami after the 7.7-magnitude earthquake rattled the western coast of North America Saturday night, sparking tsunami warnings for southern Alaska and western Canada.

Later, officials issued a warning for Hawaii as well, saying there had been a change in sea readings. About the same time, a tsunami advisory was issued for a 450-mile stretch of U.S. coast running from north of San Francisco to central Oregon.

A small tsunami created by the quake was barely noticeable in Craig, Alaska, where the first wave or surge was recorded Saturday night.

Fryer said it could take several hours for the danger to pass in Hawaii, especially if the waves get bigger.

"It's beginning to look like the evacuation may not have been necessary," Fryer said.

The National Weather Service said there were reports of water quickly receding in bays, including Hilo Bay on the Big Island.

The warning in Hawaii spurred residents to stock up on essentials at gas stations and grocery stores and sent tourists in beachside hotels to higher floors in their buildings. Bus service into Waikiki was cut off an hour before the first waves, and police in downtown Honolulu shut down a Halloween block party.

Gov. Neil Abercrombie proclaimed an emergency, mobilizing extra safety measures.

While television traffic cameras showed onlookers at the beach in Waikiki, Honolulu Mayor Peter Carlisle warned people to stay away from the surf for several days.

Where do I click again? A Windows 8 guide

    22 hrs.

With the launch?of Windows 8, buyers are about to discover a computing experience unlike anything they've seen before. Here's a guide to getting past some of the hurdles.

The main thing to know is that Windows 8 is designed especially for touch-screen computers, to make desktops and laptops work more like tablets. It is Microsoft's way of addressing the popularity of tablets, namely the iPad. But Windows 8 will work with mouse and keyboard shortcuts, too. It'll take some getting used to, though.

There are two versions of Windows 8, or more precisely, there's Windows 8 and there's Windows RT. They look the same, but they run on different processing chips. Windows 8 runs on standard chips from Intel and AMD and is the version you'd get if you're upgrading your home desktop or notebook PC. Windows RT is the version for light, small tablets and laptop-tablet hybrids.

Windows 8 will run programs written for older versions of Windows. Windows RT won't. It's limited to applications specifically written for it and available through Microsoft's store. (As a consolation, a version of Microsoft Office is included free on Windows RT devices).

Here are some tips on how to navigate the new Windows:

??When you start a Windows 8 machine, you're greeted with a screen that shows the time and a pretty picture. To get past it with a touch-screen device, swipe upwards with your finger from the bottom edge of the screen. If you have a keyboard, hit any key.

? Next, you'll see a mosaic of Live Tiles, each representing an application. Programs specifically written for Windows 8 will run in this new environment, which is unofficially nicknamed Metro. Each application fills the screen when you run it. Applications written for older Windows versions will open up in something that looks very much like the old Windows Desktop environment. You can switch back and forth between Metro and the new Desktop, though Microsoft wants people to eventually use only Metro.

? The Desktop screen lacks a Start button, so it's hard to start programs from there. Microsoft's idea is that users should learn to go to the Metro tiles to start programs or access settings, even if many programs, including some Windows utilities, will open up in Desktop. To get back to the tiled Start screen with a mouse or touchpad, move the mouse cursor to the top right corner of the screen, then swipe it down to the "Start" icon that appears. If you have a touch screen, reveal the Start icon by swiping in from the right edge of the screen.

? In the Desktop environment, you can glance at the Taskbar to see which Desktop programs are running. If you're a mouse or touchpad user in Metro and want to see what's running, you have to know this trick: Move the cursor into the top left corner of the screen, then drag it down along the left edge of the screen. If you have a touch screen, swipe in from the left edge, then quickly swipe back in.

? Neither environment will show you programs that are running in the other environment, but if you have a touch screen, swiping in from the left side of the screen lets you jump between open applications. The "Alt-Tab" combination does the same thing with a keyboard, in case you aren't using a touch screen.

? There are two versions of Internet Explorer, one for each environment. A Web page you open in one doesn't appear in the other, so if you're trying to find your way back to a page, it helps to remember which browser you were using.

? When using Metro on a touch screen, you close a program by first swiping your finger down from the top edge of the screen. That shrinks the window. Then you swipe your finger down to the bottom edge of the screen. Don't stray to the right or left edges of the screen, or the app will end up "docked" in a column along that edge. You can perform the same action with a mouse cursor by clicking and dragging from the top edge of the screen, but using the old "Alt-F4" command is easier.

? In the Desktop version of Internet Explorer, you can see at a glance which pages you have open in "tabs." In Metro, each Web page fills the screen, leaving no room for tabs.

To see which other pages are open on a touch-screen computer, you swipe your finger down from the top of the screen to reveal thumbnails of the other windows. Don't sweep too far, or you'll shrink the window instead.

If you're using a mouse in Metro, you right-click anywhere on the screen to reveal the tabs. Of course, this means right-clicking no longer does any of things it can be used for in previous versions of Windows, such as letting you open a link in a new tab.

? When Microsoft introduced Windows 95, some people thought it was amusing and counterintuitive that the procedure for shutting down the computer began with the "Start" button. In Windows 8, that incongruity is gone along with the Start button, but shutting down with a mouse or touchpad isn't obvious either. Move the cursor into the top right corner of the screen. A menu will pop out. Sweep down to the "Settings" button that appears, and click it. Then click "Power," then "Shut down." If you're on a touch screen, start by swiping in from the right edge of the screen, then tap "Settings."?

Stroke survivors who smoke raise risk of more strokes, heart attack, death

ScienceDaily (Oct. 25, 2012) ? Stroke survivors who smoke put themselves at a greater risk of additional strokes, heart attack or death than those who never smoked, according to new research in the American Heart Association's journal Stroke.

Those who quit smoking before their stroke also had less risk of poorer outcomes than current smokers, researchers found.

Researchers in Melbourne, Australia, tracked 1,589 patients who experienced a first or recurrent stroke in 1996-99. They followed them for 10 years, using medical records and in-person and telephone interviews, and tracked demographics, deaths, recurrent strokes and heart attacks.

Compared to those who never smoked:

    • Those who smoked when they had a stroke were 30 percent more likely to have a poor outcome.
    • Among those who survived the first 28 days after stroke, current smokers had a 42 percent higher risk of poorer outcomes.
    • Ex-smokers had an 18 percent higher risk of poorer outcomes.

    Compared to past smokers:

    • Among those who survived the first 28 days after stroke, current smokers had a 23 percent higher risk of poorer outcomes during the 10 years.

"This research provides fresh incentive to quit smoking now or never start because it shows smokers fare far worse after strokes than non-smokers," said Amanda Thrift, Ph.D., the study's lead researcher and professor of epidemiology for the Department of Medicine in the Southern Clinical School at Monash University in Clayton, Victoria, Australia.

In the study, those living in disadvantaged areas were much more likely to smoke, with 52 percent of current smokers belonging to the most disadvantaged group, compared to 31 percent of those who never smoked.

"We also found smoking had its greatest impact on younger patients," Thrift said. "The people who smoked in our study were younger, more often male, and more often from a disadvantaged background. Although we want everyone to give up smoking, targeting this group could yield greater benefits with fewer dollars spent."

The study focused on patients who survived the most common type of stroke: an ischemic stroke (caused by blood clot). Researchers didn't link smoking to poorer long-term outcomes for patients whose stroke was caused by bleeding within the brain (intracerebral hemorrhage ), possibly due to a small sample size.

Previous studies, which have been shorter, had a smaller sample size or were less comprehensive, have provided inconsistent results on smoking's role on long-term outcomes after a stroke.

Stroke is the fourth-leading cause of death and the leading cause of adult disability in the United States. Someone in America has a stroke about every 40 seconds.

Brink's Co shares tumble, 3Q profit falls 56 pct

RICHMOND, Va. (AP) ? Shares of The Brink's Co. fell Thursday after the armored car company said its third-quarter net income plunged 56 percent, as revenue and operating earnings from its international business sank.

The Richmond, Va., company said total earnings fell to $13.5 million, or 28 cents per share, from $30.8 million, or 64 cents per share, in last year's quarter. Adjusted earnings were 50 cents per share, excluding severance costs and retirement plan expenses among other items.

Revenue slipped 2 percent to $979 million.

Analysts surveyed by FactSet expected, on average, earnings of 61 cents per share on $1.01 billion in revenue.

The price of company shares dropped 6.6 percent, or $1.81, to close at $25.57 while broader trading indexes advanced slightly.

Brink's said operating earnings from its international business fell 17 percent to $51 million, while revenue from that business dropped about 2 percent to $744 million. In particular, the company recorded a $4 million government receivable write off in Argentina.

Brink's officials said in a statement that lower results in Latin America countered higher earnings in Europe and North America.

The company's selling, general and administrative expenses also climbed 8 percent to $147.4 million.

Brinks said it still expects revenue for the year to rise 5 percent to 8 percent, implying a range of $4.08 billion to $4.2 billion. Wall Street is expecting revenue of $3.96 billion on average, with estimates ranging from $3.92 billion to $3.99 billion.

Pro-government forces seize old Gaddafi bastion Bani Walid

BANI WALID, Libya (Reuters) - Forces loyal to Libya's government took control of the former Gaddafi stronghold of Bani Walid on Wednesday, commanders said, after weeks of fighting that have underlined the weakness of central authority more than a year after Libya's revolution.

Pro-government fighters shouted "Bani Walid is free!" as pick-up trucks mounted with weapons poured into the center of the isolated hilltop town, one of the last to surrender last year to the rebels who toppled Muammar Gaddafi.

Thousands have this month fled the bloodshed between rival militias, and pockets of resistance were still reported on Wednesday on the outskirts of Bani Walid, some 170 km (105 miles) south of Tripoli.

Bent on making their mark on a town they say still harbors many of the late dictator's followers, pro-government forces fired rocket-propelled grenades and anti-aircraft weapons at empty buildings.

Heavy gunfire thundered non-stop and smoke billowed over part of the town.

The fighters cried "Allahu Akbar!" (God is Great) and "Today Bani Walid is finished!", honking car horns and blasting patriotic music from their trucks.

Some of them climbed onto the roof of one building to hoist Libya's tricolor flag and then fired their rifles in the air.

Posters of Shaban as well as historical Misrata hero Ramadan al-Swehli hung atop one town-center building. But next to it, a coffee shop stood empty with its plastic chairs still outside, and residents were notably absent from main streets.

    "BANI WALID IS FREE"

"On this day - October 24 - Bani Walid is free. There are no more Gaddafi militias inside," said Fathi Shahoud, a commander of Libya Shield, a grouping of militias operating under the umbrella of the Defense Ministry. "Now we control the city and we will stay to ensure safety."

Tarek Nouri Abu-Shabi, a 21-year-old member of the Free Libya militia, said: "The revolutionaries have been in control since yesterday. These are rebels from Misrata, Tripoli and from other places. There are still small pockets of fighting on the outskirts. We found weapons inside the town."

Pro-government forces moved on Bani Walid this month after Omran Shaban, the fighter who found Gaddafi hiding in a drain in Sirte two months after rebels took Tripoli, died following two months of detention in the town.

The standoff highlighted the Tripoli government's inability to reconcile groups with long-running grievances, as well as its failure to bring many of the militias that deposed Gaddafi fully under its control.

The pro-government militias set out to find those suspected of abducting and torturing Shaban, and the national congress gave Bani Walid a deadline to hand them over.

"The military act is now finished. We now are working to make the city stable and more secure," army chief of staff Youssef al-Mangoush told reporters. "That doesn't mean that there isn't some resistance here or there. Now the government is in charge."

He said the pro-government forces had freed a number of people from detention and captured some fighters who used to belong to Gaddafi's son Khamis's brigade.

    THOUSANDS FLED

According to the Libyan state news agency, the clashes in Bani Walid killed at least 22 people and injured hundreds. Thousands of families fled, saying there was no water or electricity in the city and a shortage of food and medicine.

There were unconfirmed reports on Tuesday of retribution by pro-government forces.

"The militias have entered the suburbs with bulldozers and have begun to demolish homes without reason," Abdel-Hamid Saleh, a member of a Bani Walid civil society group, said by phone.

"A woman called me yesterday screaming 'They have come for me, they have come for me' in fear. The city is falling on our heads."

The Bani Walid General Hospital was evacuated this week when, according to residents, it came under a rocket and mortar barrage.

"The patients have been moved to hiding places, homes and mosques because they were under fire in the hospital," tribal elder Mohammed al-Shetwai told Reuters.

A Reuters team was unable to reach the hospital on Wednesday because of widespread shooting.

The International Committee of the Red Cross said it had previously delivered surgical supplies to treat around 100 patients wounded by shooting inside the city, as well as other urgently needed medical supplies.

WebRTC Demo Plus WebRTC Asterisk Integration

    October 24, 2012

At AstriCon at sat in a jam-packed session on WebRTC, which featured Digium's Joshua Colp and Voxeo Labs / Tropo's Tim Panton. The talk explained how WebRTC is going to change the communications landscape, but more than that they did an actual demo showing a browser-based VoIP call to a WebRTC-enabled Tropo application. The source code was ridiculously short and simple, which means a lot of the complexity has been modularized into the WebRTC spec. I captured the video using my iPhone 4S in 3 video segments. One of them was too long (17 minutes) to upload to YouTube, so I had to split it making 4 total videos of this fascinating session.
    allison-smith.jpg
The 3rd video segment is the actual demo, but the others are worth watching as well. I do wish Tim Panton did a video call during his demo since video is sexier than voice - Allison Smith, the Voice of Asterisk, not withstanding! smiley-laughing

Besides the cool demo of WebRTC in action, Tim mentioned that Chrome will "flip the switch" and enable WebRTC by default in Chrome in about a month. dancing

So without further adieu here are the four videos in chronological order:
They're HD videos, so full-screen the videos (might be able to make out some of the WebRTC code).

Squeezing in between Nokia's Asha series and the Lumia 610, the wallet-friendly Lumia 510 has been unveiled in India. The smartphone will be priced around $199 when it ships next month in India and China. It will eventually make its way to other Asia-Pacific countries and South America, but there's no news yet on any stateside availability. We did expect this Microsoft-powered device to turn up with version 7.8 of its mobile OS, but instead, there's Windows Phone 7.5 and the promise to an eventual upgrade. We've got more impressions after the break.

Girl Talk: I Think I've Figured The Allure Of Online Dating Out

Last night, I did something I thought I?d never do again, especially not on a random Monday evening: I reactivated my online dating profile.

I looked at the description of myself I wrote the last time I was single. I looked at the photos that I had thought best represented myself. ?I checked my months-old messages. I read the new messages that came in as my account had been re-activiated again. And all the while I thought, Oh fuck, oh fuck, oh fuck, what are you doing?

This morning, I deactivated it again. You see, I think I had just wanted instant gratification.

When I broke up with O?Boyfriend, a huge impetus to do so was my ambivalence about being in a relationship. I wasn?t feeling passionate about being in a relationship with him because I wasn?t feeling passionate about being in a relationship with anyone. I looked at my life ? the job I love at The Frisky, the job I love at BlackBook, my awesome friends, my supportive and loving family, my good health, my roommate?s cat who has stopped biting me all the time like the assole THAT HE IS ? and it felt complete. I feel happy right now with just me, with just what I bring to the table for myself. Adding a man to the mix felt like placing the one card on top of the whole house of cards that made it topple over.

Breakups are always crappy but I felt good about being by myself. I told my friends, my family, my coworkers and my therapist some version of ?I just want to enjoy being single for awhile.?

And I do. Ambivalent Single Lobster?forever!?But as days and weeks wore on, I started becoming more conscious of my self-esteem: my desirability to other people. One thing about not being in a relationship is that there?s 100 percent less affirmation that someone wants you. Despite all the reasons we didn?t work out, O?Boyfriend always made me feel wanted and desired; he told me all the time that he thought I was gorgeous. There was never any doubt in my mind that he was being sincere.

That?s gone now and it?s bittersweet; I am grateful to have been loved that thoroughly by someone, but I also can live without the charming self-esteem boost on tap. It doesn?t mean I don?t still want a self-esteem boost, though. Figuring out where to find it (outside of a relationship) is tricky. That part of my brain that switches off when I?m in a relationship that doesn?t pick up on other people flirting with me got turned on again ? and promptly got confused. Did the guy who said he wished he wasn?t in a relationship so he could have sex with other partners mean he might want to have sex with me? Does the woman who wants to hang out and is really looking forward to it have a little crush on me? I?m so confused!

That?s where online dating comes in. Whether guys are just looking at my profiles or send me messages and flirting, it?s confirmation of something. Sure, the only thing it confirms is someone was intrigued enough by a tiny little pixelated image, or a few sentences, to click my profile and read the whole thing. That really doesn?t mean anything. That?s like a random dude turning his head to check your ass out as you pass him on the sidewalk. But even if it doesn?t mean anything, it?s something.

I realized I had turned my online dating profile back on because I had been reading about a celebrity couple online. I felt schmoopy and nostalgic and wondered if I would ever find what she has. How will I find that? I switched my profile back on. I looked at guys who had sent me messages right around the time I deactivated my profile to date O?Boyfriend. I looked at guys who were checking my profile out now. I felt instantly gratified that, yes, some might want to be with me.

I felt chopped up with anxiety all last night and all this morning about being ?on the market again.? Because no, no, no. I?m not on the market. I?m very not on the market. I don?t want a boyfriend, let alone to respond to the inevitable series of going-nowhere online dating messages. What were you thinking, Jessica?

So I switched it off this morning and then bought myself a coffee that I love, in an outfit that I love, on my way to the job that I love. And I felt once again complete.

More Americans tap retirement funds. Is that OK?

More than 20 percent of Americans have borrowed against their 401(k), the highest share since 1996. Nearly half of young people with 401(k)s at previous employers cash them out rather than roll them over. Tapping retirement funds is rarely a good idea.

    By Margaret Price,?Correspondent / October 23, 2012

Instead of letting their retirement savings grow, a rising share of Americans are taking loans out on their 401(k)s. Four in 10 employees who leave their company cash out their 401(k)s rather than roll them into another retirement plan.

    Michael Sloan/The Christian Science Monitor

Tapping a 401(k) retirement account has proved to be quite fruitful for the Davis family of Marietta, Ga. Three years ago ? once she could do so without a penalty ? Donna Davis started taking withdrawals from her 401(k) and rolling them into a self-directed Individual Retirement Account (IRA). With the funds, the Davises bought houses for rental income.

"We're now getting a much higher return with this money than we did when it was in the 401(k)," says her husband, Jay.

That's one of the very few times that dipping early into retirement funds might be advisable. Unfortunately, amid high unemployment and tighter restrictions on borrowing, rising numbers of pre-retirees are drawing down their retirement savings and borrowing against their future. Often, they have no choice.

People "want to find ways to meet their financial obligations now," says Stanley Molotsky, a financial planner in Collingswood, N.J., who hosts a radio call-in show on personal finance. He says he has fielded "far more calls than ever before from people asking about tapping IRAs or 401(k)s."

Consider the trends: At the end of 2010, 21 percent of people with a 401(k) that allowed loans had borrowed from it, according to the latest figures of the Employee Benefit Research Institute (EBRI) in Washington, D.C. That's up from 18 percent in 2008 and the highest percentage since 1996.

That one-fifth "is very worrisome," says Jeff Vollmer, a financial adviser at Hyde Park Wealth Management in Cincinnati. "That's a large head count of those who are degrading the long-term savings potential of a tax-deferred retirement program."

The average loan size is about 14 percent of the remaining account balance, EBRI data show.

Hardship withdrawals from 401(k)s are far less common than loans. However, 4 in 10 employees who leave their company cash out their 401(k)s rather than roll them into another retirement plan or let the funds sit until they retire, according to a 2012 Aon Hewitt study. The worst offenders? Young workers in their 20s, with just under half taking the money, despite the associated penalties.

Pre-retirement withdrawals from IRAs are also becoming more common. (Loans from IRAs are not permitted.) In tax year 2010, 8 percent of the IRA withdrawals were made by households headed by individuals younger than 59, which is up from 4 percent four years earlier, according to the Investment Company Institute in Washington, D.C.

Borrowing from a 401(k) has long-term ramifications, of course, but it also has short-term implications. Although the interest rate one pays is comparatively low, borrowers are reducing their cash flow to repay their loan ? typically, it's deducted from their salary. And they are using after-tax dollars to replenish funds that had been sheltered from tax. Also, if workers leave their company, they must repay any outstanding 401(k) loans within 60 to 90 days of their last day on the job. Otherwise, they'll owe taxes on that outstanding balance. And if they're younger than 59-1/2, they'll also face a 10 percent penalty.

Nevertheless, for the cash-strapped, what other choices are there? Retirement savings could be their only way to pay for emergencies, financial advisers say. A common scenario is to borrow from a 401(k) when one wage earner in a household gets laid off, says Marcy Supovitz, head of the National Association of Plan Advisors in Arlington, Va. It's a way to tide the family over, adds Ms. Supovitz, who is also principal at a Worcester, Mass., consulting firm.

Actually, a 401(k) loan option has a distinct plus side, points out Jack VanDerhei, EBRI's research director. The fact that they can borrow from a 401(k) encourages people to join a plan in the first place.

If participants do borrow from their 401(k), they should treat loan repayments as a fixed-income holding, suggests David Wray, president of the Plan Sponsor Council of America, a Chicago-based trade association. They can then shift investments in their account to have a larger portion of the remaining balance in stocks. If stocks outperform bonds and other fixed-income assets (as they often do over the long run), then the drain on the retirement account can be minimized, he says.

All the same, the best option is not to touch retirement savings at all until retirement and, even then, strategically plan your withdrawals. "It would scare me to have to take a loan or early withdrawal from a 401(k) to pay basic bills," says Mr. Davis, whose wife redeployed her IRA assets and has now enhanced the family's financial future.

Off-the-record interview goes public, Obama lays out 2nd-term goals

Obama waves from Marine One before he departs the White House for a campaign trip. (Larry Downing/Reuters)

President Barack Obama laid out an astoundingly ambitious second-term agenda in an interview published Wednesday, vowing to forge a "grand bargain" with Republicans to reduce the national debt and achieve comprehensive immigration reform ? all in 2013.

"It will probably be messy. It won't be pleasant," Obama told the Des Moines Register's publisher and its editor by telephone. The daily made the exchange public after the White House dropped its insistence that it be off-the-record.

Messy? Unpleasant? Well, yes. Even if he wins reelection -- hardly a done deal -- few if any analysts expect the Democrats to retake the House of Representatives. And while Democrats are forecast to hold on to the Senate, betting that the president's party will secure a filibuster-proof 60-seat majority is a fool's game ? at least according to the latest polls. That makes these promises reliant on Obama using the 'bully pulpit' of the White House more effectively than he has since taking office January 2009.

[Political junkie? Sign up for the Yahoo! News Daily Ticket newsletter today]

"The good news is that there's going to be a forcing mechanism to deal with what is the central ideological argument in Washington right now, and that is: How much government do we have and how do we pay for it?" Obama said in the interview. He was referring to the so-called "fiscal cliff" at the end of 2012 ? the looming expiration of the Bush-era tax cuts, the painful automatic domestic and military spending cuts known as the "sequester," as well as the end of a temporary payroll tax reduction and some unemployment benefits.

The president has pushed for letting the Bush-era tax cuts (which he renewed entirely in late 2010 in the face of Republican pressure) expire for individuals making $200,000 or more or families pulling in $250,000 and above. Obama signaled that his longstanding offer for deficit- and debt-reduction will still be on the table, a move that could irk Democrats.

"I am absolutely confident that we can get what is the equivalent of the grand bargain that essentially I've been offering to the Republicans for a very long time, which is $2.50 worth of cuts for every dollar in spending, and work to reduce the costs of our health care programs," Obama said. (The White House quickly clarified that he meant $2.50 of spending cuts for every dollar in new tax revenue).

"We can easily meet ? 'easily' is the wrong word -- we can credibly meet the target that the Bowles-Simpson Commission established of $4 trillion in deficit reduction, and even more in the out-years, and we can stabilize our deficit-to-GDP ratio in a way that is really going to be a good foundation for long-term growth. Now, once we get that done, that takes a huge piece of business off the table.

"The second thing I'm confident we'll get done next year is immigration reform," said Obama, who has drawn fire from the Hispanic community for not keeping his 2008 campaign pledge to do just that. Republicans, meanwhile, have accused him of softening immigration enforcement for political gain.

"Since this is off the record, I will just be very blunt. Should I win a second term, a big reason I will win a second term is because the Republican nominee and the Republican Party have so alienated the fastest-growing demographic group in the country, the Latino community," he said. "And this is a relatively new phenomenon. George Bush and Karl Rove were smart enough to understand the changing nature of America. And so I am fairly confident that they're going to have a deep interest in getting that done. And I want to get it done because it's the right thing to do and I've cared about this ever since I ran back in 2008."

Republican opposition doomed immigration the last time around, and the political payoff is not always clear -- but senior Obama adviser David Plouffe told reporters Wednesday that the GOP could not afford to drive off Latino voters if the party hopes to survive.

"Republicans basically walked away from their belief that we need immigration reform. My suspicion is if you lose a presidential election to Latino voters by 40 points in a fastly (sic) growing country, the responsible thing to do if you're in that party that's losing by 40 points is to look in the mirror," Plouffe said.

Plouffe also said he thought he saw "more and more Republican senators ? saying they're more open to revenue" (meaning: tax increases). "And most Democrats have shown themselves open to do tough things on spending," he added. "It's going to require both parties coming together," Plouffe said.

The Platinum Girl Celebrity Blog | Relationship Love Gossip Rumors ...

This is an interesting story that I wanted to discuss. It isn?t about women?s relationships with men. Yet, it concerns how a woman will end her friendship with another woman because she doesn?t like the decisions her friend has made when it comes to men. Make sense?

For my example, I will use Ashley Benson and Selena Gomez. I read today that Ashley is now dating James Franco, her co-star from Spring Breakers. Before James, though, she dated Justin Bieber?s pal Ryan Good. As such, she befriended Selena. Now, Emma Roberts turned down the role and when Ashley found out about it, she begged Selena to get her in front of the producers for the part.

Once the shoot was over, Ashley told Ryan they should slow down and booked a flight to New York City to attend James? art gallery showing. This is a 180 for Ashley who generally acted possessive and insecure with Ryan to all of the sudden not having any time for him.?Selena is hurt and feels used. She supposedly only helped Ashley with the role because she thought they were all friends. Now, Selena thinks Ashley only wanted to cozy up to James.

Since I think Selena is one of the sweetest and most pulled together young women in Hollywood, it's unfortunate her feelings were hurt. I?m going to do something I don?t often do, though, and that's give someone the benefit of the doubt. I believe Ashley really did like Selena and that she was also into Ryan. However, I do acknowledge Ashley probably met James and flipped her lid for him.

The reason I say this is because Ashley was insecure about her relationship with Ryan. In case you can?t see why I?m making this leap, my point is that I think Ashley had good intentions with Ryan. From Ashley?s perspective, I?m willing to guess she felt Selena was her friend, too.

Ashley isn?t totally off the hook, though. From the way the article read, it didn?t sound as if she had a heart-to-heart with Selena and said, ?I appreciate everything you?ve done for me. But, my feelings for Ryan changed. I can?t help it but I?m falling for James. Can we still be friends?? That would?ve probably gone a long way. Even if Ashley were afraid to have this talk with Selena, she should?ve found the courage to step up to the plate.

For Selena, though, all I can say is that it isn?t always the easiest to find good girlfriends. My litmus test is whether I can be sure they?ll be there for me when the chips are down. Maybe as far as Ashley goes, Selena knows that this answer is ?No.? If not, Selena could reconsider letting her off the hook. I hope they make up.

If we all ended friendships because of foolish mistakes our friends make in romance, it?d be hard to keep anything going for a significant amount of time. Lifelong friendships require work. Think long and hard before cleaning house. Be certain the person is no good before making such a big decision that you might not be able to undo.

    Until next time?

iPad Mini and new iPad look headed to EE's 4G network

Apple's new iPad Mini 7-inch tablet and fourth-generation iPad, introduced on Tuesday, look likely to plug into EE's 4G network in the UK.

At a launch event in San Jose, Apple's marketing chief Phil Schiller presented the new iPad and the much-anticipated iPad Mini, which will go up against Google's popular Nexus device. Among their many features, both tablets will have built-in support for LTE networks, Schiller said, but did not specify which spectrum this covers.

However, British operator EE appeared in a presentation slide showing carrier partners for the new iPad - a sign that the new Apple tablets will follow the iPhone 5's lead in being able to tap into the T-Mobile and Orange operator's soon-to-launch 1800MHz-based 4G services.

"New features include a FaceTime HD camera, twice the Wi-Fi performance when compared to previous iPad models and support for additional LTE carriers worldwide," Apple said in its launch announcement.

After the launch of its previous tablet, the 'new' iPad, Apple had to field complaints over restricted LTE reach and paid an AUS $2.25m fine for marketing it as 4G, even though it didn't work on Australia's LTE networks. With the recently released iPhone 5, the company broadened its partners out, but still worked with only two 4G carriers in the whole of Europe - one of which was EE.

Perhaps due to the 4G tweaks, the Wi-Fi-only models of the fourth-generation iPad and iPad Mini will arrive first. They are set to go on sale on 2 November via Apple's online and high street stores, as well as at retail partners such as Carphone Warehouse. The 4G-capable versions will start shipping a "couple of weeks after the Wi-Fi models", Apple said.

Neither EE nor Apple had responded to a request for comment at the time of writing.

The new iPad Mini is about one-quarter thinner and half as light as the last generation of full-size iPad, according to Apple. It has a multitouch display measuring almost 8 inches, though this is not a Retina display, as some fans had hoped. Built on an A5 chip, it runs iOS 6 and promises 10 hours of battery life.

With Wi-Fi only, the iPad Mini will cost ?269 with 16GB of storage, rising to ?349 with 32GB and ?429 with 64GB. The same tablet with added 4G and other cellular capability is priced at ?369, ?449 and ?529 correspondingly.

The fourth-generation iPad is built on a new chip, the A6X, that Apple says has "twice the CPU performance and up to twice the graphics performance" of its A5X predecessor. The tablet, which has a 9.7-inch Retina display, also runs on iOS 6.

The new iPad with Wi-Fi only comes in at ?399 (16GB), ?479 (32GB) and ?559 (64GB). Add in cellular, and the prices are ?499, ?579 and ?659.

Pre-orders for all models open at Apple's online store on Friday for buyers in the UK, the US and 24 other countries: Australia, Austria, Belgium, Canada, Czech Republic, Denmark, Finland, France, Germany, Hong Kong, Ireland, Italy, Japan, Korea, Luxembourg, Netherlands, New Zealand, Norway, Poland, Portugal, Singapore, Spain, Sweden and Switzerland.
